Project Context and Scope
The national taskforce on counter trafficking and smuggling of migrants was established by the Minister of Interior through a Ministerial order No. 34/2019. The taskforce was established mainly devise measures to counter human trafficking and smuggling of persons in the Republic of South Sudan, accelerate the accension of the United Nations’ convention against organized crime and the accompanying protocols, specifically, the protocol to prevent, suppress, and punish trafficking in persons, especially against women and children, formulate a strategy and action plan including how to respond to victims of trafficking in persons. Trafficking in persons shall mean the recruitment, transportation, transfer, harboring, or receipt of persons, by means of threat, or use of force, or other forms of coercion or abduction, of fraud, of deception, or abuse of power, of a position of vulnerability, or of giving or receiving of payment(s) or benefit to achieved the consent of a person having control over another person for the purpose of exploitation ( Article 3, Palermo Protocol, United Nations Convention on Transnational Organized Crime, 2000).

Under its Better Migration Management (BMM) programme which is a regional, multi-year, multi-partner project co-funded by the EU Emergency Trust Fund for Africa (EUTF) and the German Federal Ministry for Economic Cooperation and Development (BMZ), IOM has been supporting the government of South Sudan to develop legal frameworks, strengthening capacity of the government officials and raising awareness on countertrafficking in South Sudan. This has been achieved through collaboration and partnerships with government departments and other key stakeholders such as the civil society and private sector. Under this consultancy, IOM seeks to support the development of the National Referral Mechanism for the Victims of Trafficking, which is a recommendation from the Study on Trafficking in Persons that conducted by government of South Sudan in 2020 with support from IOM.  The development of the guidelines for the National Referral Mechanism to assist victims of trafficking in persons is further echoed by the legal gaps analysis which recommended the continuous need to amend some of the Acts especially the Penal Code to reflect the many aspects of trafficking in persons and the anti-trafficking law which has just been drafted.  The mission of the NRM for Victims of Trafficking is to provide rights-based and victim-centered approaches to the provision of protection services to Victims of Trafficking. The NRM main objective is provide Standard Operation Procedures, Screening Forms, Guidelines for referral and map possible service providers in the States and the National levels. The NRM is a government led mechanism that will provide guidelines to all national, state, Civil Society Organizations entrusted with the role of protection and any other institution which will be coopted by the Government under the auspices of the National Taskforce on Counter Trafficking and Smuggling of Migrants. 

The Consultant will equip multi-disciplinary teams to deliver strategies that ensure empower trafficking survivors and service providers to toward empowerment and sufficiency. The Consultant will advise on standards and training/material and project partners, including civil society and government actors. This consultancy will involve benchmark visit to Kenya and assessment/mapping of services and contacts at selected hot spot areas of human trafficking and smuggling, including engaging with high- and low-profile stakeholders at the national and sub-national levels
 

Organizational Department / Unit to which the Consultant is contributing  

International organization for migration (IOM, Juba, South Sudan, Migration Management Unit (MMU. Under this assignment, the Consultant will directly report to the Program Coordinator MMU with overall supervision by the Chief of Mission. 

Category B Consultants: Tangible and measurable outputs of the work assignment

The overarching purpose of the consultancy is to develop the guidelines for the National Referral Mechanism to assist victims of trafficking in persons for the Government of South Sudan. he primary objective of the consultancy is to Draft the Guidelines for National Referral Mechanism for Victims of Trafficking, draft National Referral process, Map the protection service providers by states, draft standard Operation Procedures for, Identification and Referral of Votes, Protection and Assistance, Return, Readmission, and Reintegration of Votes in South Sudan with the support of the relevant stakeholders. The International consultant will provide expertise to conduct training as part of awareness raising on the referral pathways based on the 5 Ps for government, and key stakeholders involve in response to Vote. The rights-based approach as the basis for the provision of services to Votes should fit into the existing legal frameworks to harness collaborate with different institutions, key among which are agencies of government, NGOs and Civil Society Organizations. In addition, the international consultant will work in close collaboration with National Taskforce on Counter Trafficking and Smuggling of Migrants, the National Ministry of Interior and the MMU project team. The national task force will review, validate and submit the developed guidelines to the minister of interior for tabling by the Cabinet. 


    Tasks to be performed under this contract
Inception meeting with the IOM and technical working group of the NRM to agree on the framework for implementation of the assignment. 
Present the Terms of Reference to the National TIP Taskforce and Ministry of Interior for their congruence and agree on workplan and the members of the Technical Working Group for Drafting of NRM. Identify/map the protection service providers for Votes in all states of South Sudan and establish a database for referral of cases. Draft guidelines for the National Referral Mechanism for Victims of Trafficking in South Sudan in collaboration with the relevant stakeholders. The guidelines will, inter alia, include the following:Standard Operation Procedures (SOPs) for the identification, referral, protection and assistance of Votes as well as the re-integration process both at the national and sub-national levels.Mapping of services to VOTs and a database of contacts of respective service providers in the hot spot areas. strategies for tracking, reporting and managing of Votes for support by government and other stakeholders, including screening and case management tools for Votes that are aligned with the draft National Anti-trafficking law. Present the draft guidelines for validation by the National Task Force on Counter Trafficking and onward submission to the Ministry of Interior and other stakeholders for approval into a policy. Develop a training manual on the mechanism for cascading of training to service providers in the hot spot areas. The manual will aim to increase the level of knowledge of all the structures dealing with adults and children who are presumed or potential victims of human trafficking.Conduct a training of trainers (TOT) for selected focal persons of counter trafficking in respective government departments and other service organizations to cascade the training in hot spots among service providers across the States.Performance indicators for the evaluation of results

Category B Consultant hired to deliver a report on a third-instalment payment basis:

First installment: 40% of the total consultancy fee shall be due within fifteen (15) calendar days after signature of this Agreement and upon IOM’s receipt of the Inception Report that articulates the technical and methodological approach to the assignment, workplan (with timelines for each activity) and draft tools for mapping of services for victims of trafficking in South Sudan.Second instalment: 40% of the total consultancy fee shall be due within fifteen (15) calendar days after signature of this Agreement and upon IOM’s receipt of the validated draft guidelines, the database (referral directory), benchmark visit report and a draft training manual.  Third Instalment: 20% of the total consultancy fee subject to IOM’s receipt and approval of the final deliverables – final drafts of the guidelines, training manual & TOT report, referral directory and validated tools for reporting and management) and upon National task force’s verification of successful completion of all consultancy activities.


 

  Education An advanced degree in Law, Political Science, Public Policy, Social Work and Social Services or other related social sciences field. Experience Experience in drafting of national and regional policies, legislations and standard operating procedures on counter trafficking and smuggling within migration and humanitarian contexts.Good knowledge of the UN system and organizational mandates as well as interagency cooperation platforms on migration is desired. Experience of managing human trafficking, protection and capacity building projects with excellent outcomes on counter trafficking or related programs in South Sudan context, including in-depth knowledge of the counter trafficking phenomenon in the East African Community region.

Skills

Fluency in oral and written communication of English required; fluency or working proficiency of Arabic is desired.Good knowledge of the UN system and organizational mandates as well as interagency cooperation platforms on migration is desired. Languages English proficiency of language  Travel required

The consultant is required to travel to Juba, South Sudan periodically during the consultation stage, mapping and benchmark visit and drafting of the guidelines as shall be agreed with the IOM MMU project team and National Task force.
