Terms of ReferenceOperational Context
Indonesia has not yet acceded to either the 1951 Refugee Convention or its 1967 Protocol, nor to the 1954 or 1961 Statelessness Conventions. The country has yet to develop asylum legislation, and the government’s responses to refugees tend to be ad hoc and greatly reliant on the support of international organizations (primarily UNHCR and IOM.) In the absence of a legal framework and administrative arrangements, UNHCR undertakes refugee status determination (RSD) under its mandate and ensures access to fair and efficient asylum procedures for those arriving in Indonesia and seeking asylum, which is an important component of the process of facilitating the identification of durable solutions, including resettlement to a third country. The strategic use of resettlement as a durable solution for refugees in Indonesia is an important component in the implementation of the Bali Process Regional Cooperation Framework.
As of April 2023, the number of active persons of concern (PoCs) registered with UNHCR included 3,451 asylum-seekers and 9,330 refugees. Some 437 refugees have departed for resettlement while 19 refugees and asylum seekers returned to their respective countries of origin. Majority of the refugee population comes from Afghanistan (52%) followed by Myanmar, Somalia etc. In total, 51 different nationalities are represented among the population under the protection of UNHCR in Indonesia.
The population is dispersed in various locations throughout the country; the majority of persons of concern are located in urban areas, mainly in Jakarta and surrounding areas, and a significant number are residing in IOM-run community accommodation projects in cities throughout the country.
Recognized refugees lack legal status in Indonesia and are often subject to prolonged detention, but they are allowed to remain temporarily in the country pending RSD and durable solutions. Recognized refugees are assisted by UNHCR and IOM and a limited number have access to community accommodation projects. The requested staff will assist UNHCR Indonesia in completing resettlement submissions quotas for 2023.
The Snr. Durable Solutions Assistant will be part of the UNHCR Indonesia Protection Unit comprising some 50 staff (including international, national, and affiliate staff); the unit is headed by a Senior Protection Officer, and the Durable Solutions Section is led by a Durable Solutions Officer.
Duties and Responsibilities
Under the direct supervision of the Durable Solutions Officer, she/he will perform the following duties:
- Provide counselling to refugees and other persons of concern (POC) to identify the most appropriate durable solution and to enable them to make a well-informed decision.
- Interview candidates for voluntary repatriation and prepare documentation for their return, in line with Voluntary Repatriation SOPs.
- Conduct Resettlement interviews and Resettlement Referral Forms (RRF) and for profiles cleared for simplified RST-RSD process, conduct RSD interviews, and prepare assessments in line with the SoPs.
- Counsel refugees and asylum seekers on complementary pathways proc
- Interview candidates for local integration and prepare the appropriate documentation for onward submission to local authorities or partners, in line with Local Integration SOPs.
- Assist in updating the electronic database for resettlement, voluntary repatriation and local integration, in line with Standard Operating Procedures.
- Process documentation to ensure that POC receive the documents required for their durable solutions in a timely manner.
- Prepare statistical and ad-hoc reports to ensure accurate information is available and shared with relevant offices and partners.
- Assist country missions including RSC pre-screening mission; follow up on post submission deferrals, and update resettlement countries upon resolution.
- Provide technical assistance to Durable Solutions Officer for submissions of resettlement cases to resettlement countries.
- Prepare/update durable solutions information materials.
- Draft and submit reports relating to durable solutions.
- Perform other related duties as required.
Qualifications/Requirements
Education: Minimum completion of secondary education with certification, but preferably a university degree in Journalism, Social Sciences, Humanities, or related fields
Experience: 3 (three) years relevant experience with High School Diploma; or 2 years relevant work experience with Bachelor or equivalent or higher.
Nationality: Citizen of Indonesia; non-citizen with Indonesian permanent residence.
Languages: Excellent knowledge of English and Bahasa Indonesia (written and spoken).
