Project Context and Scope
Foreign spouses of Chinese citizens form a unique demographic in China's migration landscape. Their residency, work, and legal conditions can differ from those of other foreign residents, as they are legally tied to their Chinese spouses. As the volume of international marriage increases, it is important to ensure that the specific needs of foreign spouses are addressed and that their rights are protected. At the same time, marriage related crimes such as marriage fraud or human trafficking must be countered.
IOM will implement a research project aiming to contribute to improving the migration management framework for spousal migrants in China through a comparative study of relevant policies, laws and practices of both China and selected countries (Australia, Germany and Republic of Korea). This will include thorough desktop research and interviews/exchanges with officials, stakeholders and practitioners to examine how selected countries facilitate the integration of foreign spouses, in terms of their legal status, residency rights, employment conditions, and social protection, as well as how these countries address marriage fraud and other related crimes.
The research will be jointly conducted by one national and two international consultants; the latter will research 1) Australia and Germany and 2) the Republic of Korea.
Terms of Reference
Under the overall supervision of the Chief of Mission, the direct supervision of the Programme Manager, and in close coordination with other consultants of this research as well as relevant staff of IOM China, this international consultant will conduct research on Australia and Germany’s laws, policies and practices on marriage migration through desktop research as well as interviews/exchanges with stakeholders including government officials, legal experts, law enforcement representatives, local community representatives, officials in marriage registration agencies, front-line staff who work directly with spousal migrants, and most importantly, spousal migrants and their spouses. He/she will also analyze Australia and Germany’s existing policies and practices, identifying success and challenges in terms of countering marriage related crimes. In coordination with another international consultant, he/she provides support to the national consultant with the development and finalization of the final comprehensive consolidated research report, including by sharing policy recommendations in line with the findings of the comparative study in targeted countries.
Main tasks to be performed under this contract:
Develop a short paper in English outlining the methodology for the research on marriage migration in Australia and Germany, in collaboration with other consultants; methodology note including objectives, information and data collection, analytical approach, as well as timeline of the research; Produce a draft gender-sensitive international comparative analysis report in English providing a comprehensive overview of spousal migration policy, legal frameworks and implementation practices in Australia and Germany, including analysis of key strengths, good practices, and major challenges , with a focus on assessing feasibility of their adaptation to fit China's context; Contribute to the final comprehensive consolidated research report led by the national consultant by providing a final international comparative analysis report in English including the findings from the research of Australia and Germany.Education, Experience and/or skills required
Postgraduate degree in law / social / political sciences or a related field. Demonstrated expertise and experience (at least 5 years) in research, designing assessment frameworks and tools. Demonstrated experience in the area of marriage migration, including policy analysis. Extensive understanding of the migration landscape in China, with a particular focus on marriage migration. Proven capacity and experience in providing consultancy services for other organizations. Proficiency in written and spoken English. Knowledge of German is an asset.Travel required
