The development of a user-friendly training manual tailored to the judiciary is being supported under a project titled \"Supporting Lesotho in VoT Protection and TiP Prosecution,” supported by the US government. Specifically, the activity falls under Objective 1: Law enforcement and judiciary strengthen their Trafficking in Persons (TiP) response, including identification, intelligence gathering, investigation, and prosecution. In furtherance of this objective, IOM is intending to develop a user-friendly training manual tailored to the judiciary. This includes definitions and  indicators of TiP, psychological reactions of victims, interviewing victims of trafficking, victims’ needs in criminal justice proceedings in TIP cases, protection and assistance of victims of trafficking, compensation of victims, and considerations in sentencing in TIP cases. In addition, the training manual will also include a component on cross-border collaboration between Lesotho  and the South African Judiciary to follow up the TiP case  

The position will be an external, independent assignment. IOM requires a well-established international consultant with extensive experience in TiP.

The roles and responsibilities of the consultant include:

  • Undertake desk research, which includes legal analysis of the relevant laws to combat trafficking in persons as a basis for drafting a manual relevant for prosecution of TIP in Lesotho. Documents to be analysed include the following but are not limited to: recent capacity assessment on victim protection and law enforcement, existing training modules/materials to fully understand the basis for improvement, progress reports of IOM and partners on the implementation of counter trafficking projects, and case studies. 
  • Carry out a capacity needs assessment. This can be done through a workshop or interviews or a combination of both. The capacity assessment comprises a) stakeholder analysis of criminal justice and victim protection key players to assess their roles and responsibilities relevant to prosecution of TIP cases and protection of victims and b) identification of the training needs in line with the objectives of the project. 
  • Produce a well-written and comprehensive training needs assessment report based on the above, including recommendations for: selection of training sites/venues, schedule for training, identifying key resource persons, participants; Pre and post training evaluation. 
  • Facilitate a stakeholders’ validation workshop.
  • Based on this assessment, develop a comprehensive training module (in English) for judiciary (magistrates and judges) with a special focus on definitions and indicators of TiP, psychological reaction of victims, interviewing victims of trafficking, victim’s needs in criminal justice proceedings in TIP cases, protection and assistance of victims of trafficking, compensation of victims, and considerations in sentencing.
  •  Share the draft manual with key experts, including government, for their review, and finalize the module.
  • Work in close collaboration with the IOM Project team in training one Training of Trainers (TOT) workshop for the judiciary on trafficking in persons using the developed manual.

    The expected deliverables for the assignment are:

    • One validated training Needs Assessment report
    • Comprehensive training module, with a three to five days training curriculum for the Judiciary
    • One Training of Trainers (TOT) workshop completed, and report submitted, including pre and post-training evaluation. 

      The consultant will work closely with IOM Lesotho Project Management Team for the project, which comprises of project manager and the head of the office of Lesotho, who will ensure technical and administrative support is provided for the assignment. Technical oversight is provided by the regional thematic specialist for protection of IOM subregional office for Southern Africa. 

      The project team will be responsible for providing all logistical support required for the execution of the assignment, including but not limited to introducing the assignment, its purpose, and the consultancy firm to the different identified participants in advance and acquiring their early consent to participate in the assignment, making appointments in time for virtual or physical interviews or discussions; following up and reminding participants of agreed appointments, required documentation or information and ensuring that Project Management Team members provide inputs/comments to the various deliverables on time.

       

      The successful Lead consultant should have the following qualifications and experience:

    • A Masters Degree/PHD in Law, Criminology, Human rights and Political Science.
  • At least 5-7 years of prior work experience in the field of training, trafficking in persons, human rights etc. especially in the regional and international context.
Demonstrated knowledge and experience in conducting need assessments and developing training modules/curriculum, training materials etc. Demonstrated experiences and skills in facilitating stakeholder/working group consultations and training. Relevant regional and international experience will be an added advantage. Excellent writing, editing, and oral communication skills in English. The project seeks to identify experts that fulfill the above criteria and have demonstrated ability to involve judiciary to provide relevant expertise and bring a wider perspective in development of the training manual
