TERMS OF REFERENCE FOR CONSULTANT
Nature of the consultancy: Anti-trafficking training and technical assistance
Objective: The objective of this consultancy is to support the Government of Solomon Islands to accede to the UN Convention against Transnational Organized Crime (UNCTOC) and The Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children by developing the TIP protocol instrument to enable this process.
Target: The Accession process will involve UNCTOC committee engaged in counter trafficking, including civil society organizations, community-based organizations, religious groups, non-governmental organizations, international organizations, law enforcement, and personnel from appropriate ministries and governmental bodies (The Prime Minister Office, Ministry of Foreign Affairs and External Trade, Ministry of Women, Youth and Children and Family Affairs, Ministry of Commerce, Immigration, Labour and Industries, , Ministry of Justice and Legal Affairs, Ministry of Provincial Government and Institutional Strengthening, Ministry of Police, National Security and Correctional Services , MPNSCS, et al).
1. IOM Project to which the Consultancy is contributing: Accession to UN Convention against Transnational Organized Crime (UNCTOC) and TIP Protocol
- IOM is currently implementing project in Solomon Island providing technical assistance to the government to accede to UN Convention against Transnational Organised Crime and Protocol to Prevent, Suppress and Punish Trafficking in Person, especially Women and children. The project supports the work of UNCTOC working committee through the provision of legislative and technical assistance in the ratification and implementation of the UN convention Against Transnational Organised Crime (UNCTOC) and its supplementary protocol against human trafficking.
The key outcome of this consultancy will be the completion and submission of the UNTOC TIP Instrument to cabinet, and publication and for parliament endorsement. In addition, technical assistance will include coordination meetings, workshops, and reports for preparation for the Trafficking in Person (TIP) Instrument and related procedures therein.
2. Tasks to be performed under this contract:
The consultant will work under direct supervision of the interim Project Manager and National Human trafficking coordinator in Solomon Islands and in close collaboration with leading government organisations.
The consultant will support the implementation of project activities with the following specific responsibilities:
Preparation work:
- Support the International Consultant by conducting a substantive national situational analysis and legislative review using multiple research sources and submit review to the UNTOC working committee
- Sharing the key outcomes of the situational analysis and desk review with the International Consultant
Coordinate input with the UNCTOC Working Committee:
- Promote the ratification and implementation of the UN Convention against Transnational Organized Crime (UNCTOC) and its supplementary Trafficking in Person (TIP) Protocol with stakeholders through meetings, consultations and dialogues
- Facilitate meeting sessions with working committee to integrate feedback from the two Provincial Consultation Workshops
- Have separate meetings via webinar with UNCTOC working committee on scheduled dates
- Assist the International Consultant in preparing substantive legal input for drafting of the TIP Instrument in coordination with the UNCTOC working committee
- Support the International Consultant in preparing the outline and structure prior to drafting the TIP instruments and disseminate to working committee to review and provide final feedback before finalisation
- Support the International Consultant in providing key information, clear process and requirements for cabinet submission of TIP protocol concept paper for official endorsement by the cabinet
- Perform any other duties as may be assigned
3. Tangible and measurable output of the work assignment
- Completion of the comprehensive desk review of legislative assessment and gaps and submitted to the UNTOC working committee for review and finally share with international consultant.
- Completion of the Cabinet Paper on TIP protocol, reviewed and submitted to Cabinet via UNCTOC working committee
- Reports on national and provincial UNCTOC workshops with clear recommendations and key steps.
- Production of draft TIP instruments for review by International Consultant
- Completion of the clean version of the UNCTOC TIP instrument for submission and final coordination and publication and for parliament endorsement.
4. Delivery dates and details as to how the work must be delivered:
October 19
- Support the International Consultant by conducting a substantive national situational analysis and legislative review of specialization using multiple research sources and submit review to the UNCTOC working committee
- Sharing the key outcomes of the situational analysis and desk review with the International Consultant
November 19
- Promote the ratification and implementation of the UN Convention against Transnational Organized Crime (UNCTOC) and its supplementary Trafficking in Person (TIP) Protocol with stakeholders through meetings, consultations and dialogues.
- Facilitate meeting sessions with working committee to integrate feedback from the two Provincial Consultation Workshops

- Support the International Consultant in preparing the outline and structure prior to drafting the TIP instruments and disseminate to working committee to review and provide final feedback before finalisation
- Support the International Consultant in providing key information, clear process and requirements for cabinet submission of TIP protocol concept paper for official endorsement by the cabinet.
- Perform any other duties as may be assigned
5. Performance indicators for evaluation of results:
15% upon delivery of approved completed desk review of legislative assessment and gaps
15% upon delivery of the approved cabinet paper
35% upon delivery of approved complete draft report of the legal preparation of key outcomes from the two provincial consultation workshops, and approved draft of workshop reports
35% upon delivery of the completed draft of the TIP instruments and submission to Cabinet
6. Required Qualifications and Experience:
Education
- Advance University degree in law, criminology, political science, international relations, or related social political or economic areas, with adequate focus on human trafficking, crime prevention and criminal justice and related areas or related field with 7 years relevant professional experience
Experience
- At least seven years of professional experience in criminal law, crime prevention and criminal justice with a focus on combatting human trafficking, organised crime or related forms of crime, or experience as a prosecutor or as a lawyer conducting normative legal work such as drafting legislation, regulations, or other legal guidance and advising on legal interpretations related to human trafficking, organised crime, or related forms of crime.
Experience in an International development context, working in international settings, or in conducting technical assistance programmes is required
Experience interpreting and drafting and/or revising legislation required
Work experience with strong technical expertise in combatting trafficking-in-persons on regional and international level is desirable
Familiarity with international legal framework on transnational organised crime, human trafficking and other related fields is highly desirable.
Experience supporting government and non-government stakeholders through targeted capacity building activities on combatting trafficking-in-persons
Experiencing in preparing, finalizing and circulating protocols, instruments, policies, implementation plans or government action plans
Excellent stakeholder coordination and consultation skills
Field experience in a developing country is an asset
Pacific experience highly regarded
Excellent writing skills, experience with writing criminal and human trafficking instruments or policy documentation, excellent self-organization skills, punctuality in meeting deadlines.
Languages
Fluency/proficiency in oral and written English language is required.
Other Skills
Good research and analysis, report writing, and legal drafting skills and IT literacy is required
