Duties and ResponsibilitiesBackground The main mandate of the United Nations Human Settlements Programme (UN-Habitat) is to promote sustainable development of human settlements and policies conducive to adequate housing for all. Within this framework, UN-Habitat supports central and state governments, as well as local authorities and other partners for the implementation of the Habitat Agenda, the 2030 Agenda with the Sustainable Development Goals and the New Urban Agenda. UN-Habitat helps the urban poor by transforming cities into safer, more inclusive, compact, integrated, resilient and connected places with better opportunities where everyone can live with dignity. It works with organizations at every level, including all spheres of government, civil society and the private sector to help build, manage, plan and finance sustainable urban development. The Regional Office for Latin American and the Caribbean – ROLAC – is based in Rio de Janeiro, Brazil. The Agency puts emphasis on developing and managing activities in the host country. Indeed, for the past years, UN-Habitat has expanded its portfolio in Brazil by working with the three tiers of government in order to support the formulation and implementation of more effective, sustainable, participative and socially fairer urban economic, social and environmental policies. In order to expand the programme and seek support to work with the challenges of reducing urban poverty and integrating all segments of the population into the fabric of the city, UN-Habitat is a partner of Instituto Pereira Passos (IPP) of the Municipality of Rio de Janeiro (PCRJ) in the implementation of the Social Territories Programme. To respect, protect and achieve rights and build a fairer and more equitable city, the Social Territories Programme aims to identify the most vulnerable urban population of the city of Rio de Janeiro, better understand their living conditions and promote a specialized support to integrate them into public registries, the network of basic services and the municipal urban fabric. To continue with the due implementation of the Social Territories Programme, UN-Habitat office in Rio de Janeiro is looking for a Legal Data Protection Consultant. Report to UN-Habitat Manager The Legal Data Protection Consultant reports to the Head of Brazil Office and OiC for Southern Cone Office who will evaluate him/her. Outputs/Work Assignment The Legal Data Protection Consultant shall support and advise on the implementation of programme activities according to the responsibilities indicated below. Expected outputs The Consultant will be responsible for writing and delivering the following outputs: Product 1: Risk management plan Description: Risk management plan related to the processing of personal social assistance and infrastructure data of families interviewed by the Social Territories Programme team. Expected delivery date: 30 days after signing the contract. Product 2: Technical proposal Description: Technical proposal for mapping and data inventories to be used by the programme in relation to social assistance and infrastructure. Estimated delivery time: 60 days after signing the contract. Product 3: Examples of legal instruments Description: Map examples of legal instruments in which personal data is processed or shared in social assistance and infrastructure, and which require future modifications to adapt to the General Personal Data Protection Law (LGPD) is necessary. Expected delivery date: 90 days after signing the contract. Product 4: Data Protection Impact Report (DPIR) Description: Data Protection Impact Report (DPIR) on social assistance and infrastructure. Expected delivery date: 120 days after signing the contract. Product 5: Social Assistance and Infrastructure Personal Data Classification Plan Description: Social Assistance and Infrastructure Personal Data Classification Plan with detailed information and suggestions. Expected delivery date: 150 days after signing the contract. Product 6: Social Assistance and Infrastructure Data Protection Impact Report (DPIR) Description: Data Protection Impact Report on social assistance and infrastructure. Expected delivery date: 180 days after signing the contract. Responsibilities Under the overall supervision of the Head of Brazil Office and OiC for Southern Cone Office, the Legal Data Protection Consultant will: 1. Technically assist the Programme regarding data protection • Technically assist the Programme according to programme documents and agreement signed regarding data protection. • Prepare and review products according to the agreed outcomes and indicators. • Ensure programme implementation as per the work plan with support from programme staff. • Anticipate and mitigate risks to programme, including relevant challenges or omissions and other situations that may affect development and implementation of the programme regarding the use of data. • Research about data protection best practices. • Provide information for the systematization and exchange of successful practices and experiences with other offices in the region and with headquarters divisions, as well as Brazilian experiences on data protection. • Ensure that the technical activities are aligned with the quality expectations of the Agency and its counterparts. • Record and maintain documents on relevant programme activities, issues, and risks. • Attend meetings and conferences promoted by partners to strengthen Project position and presence in the territories. • Undertake any other duties and responsibilities within the incumbent’s expertise that can be reasonably expected to help maximize the efficiency and effectiveness of UN-Habitat’s response to urban development issues. • Perform other duties which may be requested by the supervisors. The consultant will be responsible for completing all courses or training activities that are indicated to him/her by his/her supervisor. The security course BSAFE is required to be accredited during the first month of employment. The consultant will be responsible for his/her own security, so the person should get familiarized with United Nations security mechanisms and comply with them according to the Framework of Accountability for the United Nations Security Management System. Qualifications/special skillsAcademic Qualifications: Required: ● Graduation in Law or additional 3 years of relevant experience to the post, beyond the requirement. Experience: ● A minimum of five (5) years of progressively responsible experience in law and/or data protection. ● Professional experience on themes related to public policies, slums, data analysis and information, social and urban development, articulation and coordination of stakeholders on implementation of policies and projects is desirable. ● Previous experience within the UN System is an asset. Skills: ● Good computer skills in Windows, Word, Excel, Outlook and Web search engines are required. ● A good knowledge of project management methodologies is desirable. Knowledge Management → The person must know the processes, procedures and norms of UN-Habitat, in order to guarantee an adequate quality of the activities described above, following the standards of the organization. → The person will propose formats and procedures that allow the efficient implementation of the activities related to the project development. → The person must know the file of the Office, work with it and ensure its proper maintenance, accessibility for all staff and due updating. → The person will prepare databases related to the project running. → The person will make sure that all relevant technical information will be adequately shared with the correspondent staff. → The person will ensure that all produced material will be fit-for-purpose and delivered, in an organized way, for posterior consultation and use of the Agency. Knowledge of Spanish and/or is desirable. ● English and French are the working languages of the United Nations Secretariat, and Spanish is the working language of the Regional Office.
