1. General Background

Honduras is characterized by a situation of protracted internal displacement due to violence. It continues to be affected by high levels of violence representing a challenge in terms of protection and assistance.

Honduras has made significant progress in responding to the situation of forced internal displacement since the creation of the Inter-Institutional Commission for the Protection of Persons Internally Displaced by Violence (CIPPDV) in 2013 to date, under the leadership of the Secretariat for Human Rights (SEDH). The SEDH in the framework of the CIPPDV led since 2015 the process of building a comprehensive legal framework in response to internal displacement that concluded with the approval of the Law for the Prevention, Attention and Protection of Internally Displaced Persons on December of 2022 by the National Congress and, its publication in the official gazette \"La Gaceta\" on March 2023.

The law entered in force on 19 April. Article 78 of the Law states that the Secretariat of the Office of the Presidency together with the SEDH, in coordination with other actors, must issue the Regulations within the next 6 months from its entry into force.

The UNHCR has been a strategic ally of the CIPPDV and the SEDH in the development and promotion of measures in response to internal displacement, particularly the Displacement Law. As part as this strong collaboration, UNHCR and the SEDH have agreed that UNCHR would support the SEDH by contracting a highly specialized professional with the required technical skills to provide assistance for the development of the Law's regulations.

2. Purpose and Scope of Assignment

Support the SEDH to spearhead the development and implementation of a workplan, involving relevant stakeholders, for the drafting of the regulation of the Law for the Prevention, Attention and Protection of Internally Displaced Persons.

To this end, the selected candidate should provide technical advice and support to State institutions and have permanent coordination with the Secretaries of State in the Offices of the Presidency and Human Rights Secretariats, under the supervision of UNHCR.

The selected candidate will provide inputs and contributions in writing to be used for the draft regulation of the law, according to (i) the Guiding Principles of Forced Displacement, (ii) the international standards to prevent internal forced displacement and protect IDPs, persons at risk and returnees in need of protection. The orientation must be coherent with national legal and institutional frameworks related to the dispositions of IDP legal framework.

The main activities and expected outputs of this position are:

Activities:

i. Develop a detailed work plan for the delivery and implementation of the expected outputs. The workplan and pipelines should consider key stakeholders, inputs, and products to support the production by SEDH of a draft of the IDP Law’s regulation.
ii. Propose methodologies and instruments for systematization and analysis of consultations to generate content for the Law's regulation. This process should include the organization, call and coordination of meetings, interviews, workshops, consultation exercises, among others, with internally displaced and at-risk persons, public institutions, civil society organizations, international and cooperation agencies, and other relevant stakeholders.
iii. Contribute and support the State Secretariats with competencies in the Law’s regulation to develop the content and functionality in accordance with the framework established in the Law, ensuring its correspondence with the general regulatory frameworks of the country. This includes the process of coordination, design, development and facilitation of the necessary methodologies.
iv. Mapping and analysis of normative and legal frameworks to be considered in the process of regulation and implementation of the Law such as: national legislation, manuals and guidelines, international human rights and humanitarian law instruments, policies, reports, articles, studies, among others.
v. Provide technical and legal assistance to the SEDH in the preparation, drafting, review and validation phases of the contents of the Regulations of the Law for the Prevention, Attention and Protection of Internally Displaced Persons. The contracted person shall share the progress made in a timely manner for feedback from the Secretariats and UNHCR.
vi. Ensure fluid and permanent communication between the Secretariats and UNHCR to achieve the expected outputs.
vii. Others tasks as necessary for the achievement of the hereby outlined objectives and expected outputs.
viii. Perform other related duties as required.

3. Monitoring and Progress Controls

The UNOPS Contractor will be required to:

Deliverables/outputs:
1. A work plan with its respective timeline and responsibilities for the development of the activities and delivery of the expected outputs listed below.
2. Document with the mapping of stakeholders, inputs, and products required to assure a draft of the IDP Law.
3. Document with the methodology for the development of the Regulation of the Law for the Prevention, Attention and Protection of Internally Displaced Persons. This must contain at least: i) a detailed pipeline of activities and expected deliverables; ii) coordination mechanism for the drafting of the Regulations (between the Secretariats, CIPPDEF, IDPs, persons at risk and returnees and UN agencies); iii) Mapping of public institutions, civil society and international organizations to be involved in the regulation, in accordance to the law; iv) Consultation methodology, differentiated by sector and population group, as well as the instruments to be used. The methodology must include a human rights, gender and diversity approach; v) Socialization and validation of the results of the consultations and the contents of the Regulations. All meetings and consultations must be systematized to support inputs and products needed to draft the regulation.
4. Document with the mapping and analysis of regulatory and legal frameworks to be considered in the process of regulation and implementation of the Law.
5. Document with the systematization and analysis of the results of the consultations carried out, whose purpose is to provide concrete and relevant inputs for the drafting and validation of the Regulation.
6. A finalised proposal document of the draft Regulation of the Law for the Prevention, Attention and Protection of Internally Displaced Persons.
7. Socialization of the draft regulation, with the Secretariats and with the Interinstitutional Commission for the Protection of Forcibly Displaced Persons (CIPPDEF).

4. Qualifications and Experience

a. Education (Level and area of required and/or preferred education)
Bachelor’s Degree preferably in Law, International Law, Political Science, International Relations, or other relevant discipline is required.

b. Work Experience
1-year relevant experience with Undergraduate degree; or no experience with Graduate degree; or no experience with Doctorate degree.

Relevant Job Experience

Essential
- Knowledge of International Refugee and Human Rights Law and ability to apply the relevant legal principles.
- Experience in the development of public policy, drafting executive and legislative decrees, review and drafting of legal frameworks and regulations, with a human rights and protection approach.

Desirable
- A minimum of 1 year and progressive professional experience in coordination process with public institutions and drafting documents related with these terms of reference.
- A minimum of 1 year of work experience in the exercise of the profession and/or in public administration and/or related consultancies, etc.
- Proven knowledge and experience in internal displacement due to violence, human rights advocacy and coordination of stakeholders (Government, communities, NGOs, cooperation agencies, etc. ).
- Proven experience in (i) design, implementation, and monitoring public policies, (ii) drafting executive and legislative decrees, (iii) review and drafting of legal frameworks and regulations, with a human rights and protection approach.
- A proven track record with at least 1 year experience in coordination is an asset.
- Experience and demonstrated skills in generating and compiling high quality reports is an added

- Proven experience of at least one (1) year in public administration, coordination of multisectoral and cooperation processes and/or consultancies in the humanitarian, human rights and/or violence area.
