Terms of ReferenceTitle of project: Consultancy for the preparation of guidance material for the creation and maintenance of association/organizations for indigenous and migrant refugees

Purpose of the project:
To support the creation and maintenance of organizations for indigenous
refugees and migrants, the United Nations High Commissioner for Refugees (UNHCR) will contract a consultancy. Based on a culturally differentiated methodology, the intention is to 1) map existing organizations in Brazil, as well as consult them remotely through focus groups regarding their functioning and the challenges they face; 2) develop a bilingual information booklet on the creation and maintenance of organizations; and 3) empower communities to receive information about the creation and maintenance of civil society organizations.

Suggested fee (daily/weekly/monthly/lump sum) and currency:
The total budgetary amount allocated for individual contracts(incl. travel and DSA etc.): BRL 20,000.00
Payment schedule:
The first payment on October 2023, after the satisfactory delivery of Product 1, corresponding to BRL 6,000.00 (six thousand reais)
The second payment on November 2023, after the satisfactory delivery of Product 2, corresponding to BRL 8,000.00 (eight thousand reais)
The third payment on December 2023, after the satisfactory delivery of Product 3, corresponding to BRL 6,000.00 (six thousand reais)
General Background of Project or Assignment:
• In recent years, thousands of Venezuelans have crossed the border into Brazil in search of international protection. Due to hyperinflation, food shortages, the need for medical attention, and political persecution, many people were forced to leave their country. Among them, there are more than 9,000 indigenous people belonging to different ethnic groups:
Warao (6.462 indigenous people), Pemon-Taurepang (2.679 indigenous people), E'ñepa (226 indigenous people), Kariña (194 indigenous people), and Wayúu (64 indigenous people).

• Currently, there are families of indigenous refugees and migrants in all Brazilian states. Many are housed in emergency reception spaces. Others live in rented housing or in spontaneous occupations located mainly in urban areas, where they often must deal with racist and xenophobic discourses and practices. This population faces a series of obstacles to accessing rights and services in Brazil, whether in terms of access to documentation, health, and
differentiated education, or access to land and housing.
• One of the ways found to overcome these barriers has been the creation of their own sociopolitical organizations. Following the example of the organizations that make up the
Brazilian indigenous movement, indigenous refugees and migrants are creating councils or
associations to claim rights, participate in the design and implementation of public policies, and obtain funding for projects that can bring improvements to their communities. These organizations constitute an important tool for community empowerment and autonomy.
• However, not all communities know the administrative and legal ways to create their own organization. On the other hand, those who managed to create do not necessarily know how the organization can and should work. As with other social groups that adopt associations to exercise citizenship, many communities find it difficult to re-elaborate the statute, hold elections, obtain funding, render accounts, etc.
• Due to the challenges faced by indigenous refugees and migrants in the creation and maintenance of organizations, UNHCR will contract a consultancy whose objective is to support the organizations created by indigenous refugees and migrants in Brazil to date.

Overall, Purpose and Scope of Assignment:
A concise and detailed description of activities, including measurable outputs and delivery dates, impact indicators (what qualitative and quantitative results would be achieved upon completion of individual contract), performance indicators (timelines, value of the service rendered in relation to the cost, timeliness) and work plan:

The contractor will have the following tasks:
• Mapping of organizations of indigenous refugees and migrants in Brazil (formally created or in the process of being created), as well as consulting them remotely through focus groups regarding their functioning, location, administrative and legal situation, a profile of members, actions, and activities carried out, support network, the challenges they face, etc.
• Preparation of a technical report with the mapping of organizations of indigenous refugees and migrants in Brazil (formally created or in the process of being created), data on the functioning location, administrative and legal situation, a profile of members, actions, and activities carried out, support network, the challenges they face, etc., and analysis of the results of the consultations.
• Development of a bilingual, culturally sensitive manual, aimed at indigenous refugees and migrants, with information on administrative and legal procedures for the creation and maintenance of civil society organizations, such as councils and associations. This should be done with an indigenous Brazilian organization, with experience on indigenous association.
• Feedback and training of indigenous refugees and migrants, with the objective of disseminating the results of the consultancy, as well as sharing the content of the bilingual booklet.

Timeframe for delivery of products
Phase One Products – Preparing the technical report:
• Carry out a mapping of organizations of indigenous refugees and migrants from Brazil, both those that were formally created and those in the process of being created.
• Elaboration of methodology for carrying out the consultation process with indigenous refugees and migrants.
• Conducting focus groups (remotely) with indigenous refugee and migrant organizations located on the map. The objective is to understand, among other issues, where they are located, who their members are, if there are representation of women and young people, how they work if they have institutional support, and what are the challenges faced. Attention
should be paid to the sociocultural specificities of indigenous populations, linguistic differences, as well as connectivity difficulties.
• Elaboration of a technical report with analysis of secondary data and primary data obtained during focus groups with indigenous refugees and migrants.

Phase Two Products – Preparing the bilingual booklet:
• Elaboration of a bilingual booklet (Portuguese/Spanish) aimed at indigenous refugees and migrants who have created or intend to create their own political organizations.
• Among other issues, the material should answer the following questions: • What is a civil society organization? • What types of organizations exist in Brazilian legislation? • What is social participation? • What do you need to know to create an organization? • What are the necessary procedures? • Where can I get information? • Can refugee people create an organization? • What is a statute? • What is the electoral process like? • Who can join an organization? • Who cannot join an organization? • Once the organization is created, how
should it function? • How is it not supposed to work? • What is the role of each member of an organization? • What can an organization do? • What can't an organization do? • How can an organization obtain resources/funding? • How should an organization be held accountable?
Phase Three Products – Empowering Indigenous Organizations:
• In coordination with APIB and UNHCR provide feedback and training for indigenous refugee and migrant organizations that participated in the consultation process.
• The training should be given remotely and should address all the topics covered in the booklet.
Attention should be paid to the sociocultural specificities of indigenous
differences, as well as connectivity difficulties.

Qualification and experience required (degree required, years of work experience, field of expertise, language required):
- University degree in relevant fields of study such as Social Sciences, Anthropology, Public Policy, among others.
- Minimum of 5 years of relevant professional experience in research, project analysis, facilitation, and organization of participatory consultations, and multisectoral discussions such as conferences, with the indigenous population and/or refugee components.
- Specific work experience with indigenous communities and/or refugee and migrant population is desirable.
- Knowledge of digital tools for consultations, meetings, and virtual conferences.
- Proficiency in Portuguese, including excellence in grammar and writing. Knowledge of Spanish will be assessed as advantageous.
