As part of the UNDP BiH’s Rural and Regional Development Sector’s portfolio, the Enable and Manage more Beneficial Civil Society Environment (EMBRACE) aims to support social development through capacitating civil society actors to better address the needs in local communities. EMBRACE project is funded by the Norwegian government in the amount of 5 million NOK (1 million BAM), and over the course of one year the project will work with more than 20 civil society organizations (CSOs) from Bosnia and Herzegovina and relevant government stakeholders to improve services for more than 3,100 citizens. The Project will also work on identifying and addressing gaps in the policy enabling environment for the public funding of CSOs. Thus, EMBRACE will closely collaborate with the state and entity ministries.
The purpose of this assignment is to provide support and expertise to the Project and Ministry of Justice of the Federation of Bosnia and Herzegovina, (hereinafter: the institutional stakeholders) in undertaking the Regulatory Impact Assessment (RIA) of the future regulation of financing civil society organizations in the Federation of Bosnia and Herzegovina (FBiH).
The main objective of the RIA is to assess the likely benefits, costs and effects of the new legislation for financing civil society organizations in the Federation of Bosnia and Herzegovina (FBiH), its prospective impact on the society (civil society environment, public budgets, social status of citizens and groups and environment) and to offer the most appropriate solutions based on the conducted analyses.
Specifically, the RIA is aimed at improving understanding of the need for adoption of the new legislation based on the real-world impacts of the government action; raising effectiveness and efficiency of public administration; integrating multiple policy objectives and improving transparency and government accountability through the provision of more extensive information on and the demonstration of how government decisions benefit the society.
The RIA will be conducted by a national consultant, who will closely work in consultation with and under the guidance and supervision of the Programme Office and Regional Programme Manager. Specifically, the Consultant will be responsible for the following tasks:

Task 2: Conduct the assessment and produce a draft report with a detailed RIA of the future regulation of Financing Civil Society Organizations in the FBiH including consultations with institutional stakeholders
In conducting the assessment and preparing the draft RIA, the consultant will focus on the following key RIA elements:
For purposes of preparation of the Draft RIA Report, the Consultant will collect relevant data by telephone and face-to-face interviews with stakeholders, or via sharing paper questionnaires, organizing online surveys, focus groups, etc.
Following the preparation of the RIA document, the Consultant will be expected to support the institutional stakeholders in conducting consultations. More specifically, consultation meetings will be held with the Federal Ministry of Justice, the Federal Ministry of Finance, the Office of the Government of Federation of Bosnia and Herzegovina for Legislation and Harmonization with European Union Regulations, Tax Administration office of the FBiH the Gender Center of the Federation of Bosnia and Herzegovina, the FBiH Association of Municipalities and Cities and other relevant stakeholders. One debriefing session will be held at the end of the assessment process to present the main findings of the assessment.
The final debriefing session will be held, either in person or in a form of an online debriefing session (online meeting), after which the Draft RIA Report must be formally approved by UNDP. The Task 2 will be completed by the end of August 2020 and the level of effort for the Task 2 will not exceed 13 expert days.
Task 3: Submission of the Final RIA Report
Following the consultations from Task 2, the Final full RIA Report along with recommendations will be prepared in line with the Decision of the Government of FBiH on Regulatory Impact Assessment (“Official Gazzete of the FBIH“, No. 55/14 and 19/20) and will be submitted to and validated by the institutional stakeholders and the UNDP. Final full RIA Report along with recommendations will be prepared in one of the official languages in BiH.
This task will be completed by mid-September. The level of effort will not exceed 2 expert days.
