Background
The political and security situation in Libya remains fragile. In April 2019 an intensive war erupted among the rival administrations in the east and west of Libya. During the months of May and June 2020, the battle lines were pushed back from the outskirts of Tripoli to the vicinity of Sirte. The United Nations is deeply concerned regarding the deteriorating humanitarian and economic condition which is further compounded by the COVID19 pandemic and is calling on all the sides to the conflict for an immediate de-escalation and to cease all hostilities and military movements, and swiftly conclude the ongoing negotiations within the intra-Libyan 5+5 Joint Military Commission (JMC) with a view to reach a formal, comprehensive, and permanent cease-fire agreement under UN auspices in Libya.
Libyan people, especially women, girls and children are the most vulnerable segments of population, who are badly affected by this war and subsequently by the collapse of public services, particularly in health and education. The lack of rule of law and, consequently, the increased level of crime and corruption in the country has paralyzed every sector.
The expulsion of extensive foreign health workers, especially nurses and midwives has caused an acute shortage of midwives and nurses. In addition, there are major gaps in the distribution and quality of services. Poor education quality, lack of competent midwifery educators, political commitment, lack of investment and accountability, inadequate midwifery workforce policies, lack of legal and societal recognition of midwives and their scope of practice, insufficient resources and lack of conducive environments for nursing and midwifery care are the multifaceted challenges that hampers the provision of health services in Libya. This has also adversely impacted the motivation, distribution and retention of the midwifery workforce and puts health gains in Libya at greater risk.
United Nations Population Fund (UNFPA) is supporting the UN recognized Government of the National Accord of Libya in its effort to improve access to maternal health and increase resilience of health system in the face of conflicts and political instability. In partnership with the Ministry of Health (MoPH) and Ministry of Education, UNFPA works strategically to strengthen the midwifery profession in an effort to promote maternal and newborn health through five identical pillars of establishment of an enabling environment, development and recognition of midwifery and nursing workforce, improving the quality of education, strengthening regulations and association.
Description of the Assignment:
The purpose of this consultancy is to assist the Ministry of Health in Libya and its relevant technical and policy directorates to develop a National Policy and Strategy for Nursing and Midwifery Services along with its strategic action plan, M&E and proposed institutional setup for its implementation.
The more specific objectives are:
a) Prepare a National Policy and Strategy for Nursing and Midwifery Services (2020 - 2030)
b) Produce an Implementation Plan based on the revised strategy, (2020-2030) for accelerating nursing and midwifery development in Libya addressing components as education, regulation, Professional associations, workforce, enabling environment, services, advocacy and midwifery recongnition in line with the vision for Nursing and Midwifery 2030
c) To embed a communication and an advocacy component in the Policy and Strategy document that can mobilize resources and support for the implementation of the strategy and action plan.
d) Prepare a monitoring and evaluation mechanism of the implementation plan
e) Develop budget/costing for its annual implementation plan
f) Establish a proposed institutional framework for MoH Libya in line with the recommendations of the Strategy to implement the action plan and in congruence with the laws and policies of the government and ministry of health in Libya.
Expected outputs
i) An inception report that will cover the purpose, scope and methodology according to the ToR **
ii) A nationally approved user-friendly National Policy document, a strategy for Nursing and Midwifery Services for Libya (2020-2030) including clear interventions and activities to assist Libya to work towards the vision of Midwifery 2030**
iii) A costed action plan with proposed budgetary requirements for MOH and its stakeholders in Libya.**
iv) Power-point presentations for the key points of the policy, strategy and action plan and the institutional framework. **
Process and Methodology
a. Conduct a desk review of relevant documents and materials related to nursing and midwifery and in particularly applicable to Libya to understand context and environment
b. Conduct bilateral meetings and focus group discussions with policy makers, key nurses, midwives and other stakeholders (e.g. MoH, professional health associations, academia, Non-Government Organizations (NGO), UN agencies etc.) to analyze situation and context
c. Conduct environmental and SWOT analysis related to nursing and midwifery in Libya. This activity should be undertaken with the government, professional associations, academia, NGO and UN agencies involved in nursing and midwifery activities
Based on the findings from the desk review, bilateral meetings, focus group discussions, the environmental and SWOT analysis:
Develop the monitoring and evaluation framework for the implementation plan
Consensus building
In close collaboration with the working groups identified by the Human Resource Directorate, relevant Nursing and Midwifery Departments, the consultant will lead the strategy development process under the leadership of HR directorate and in collaboration with international cooperation office (ICO) of MoH and the Nursing and Midwifery Steering Committee and:
a. Conduct national consultation workshops with key stakeholders
b. Present findings for validations
c. Incorporate received feedback into the revised policy, strategy, implementation plan and the monitoring and evaluation framework
d. Present an institutional framework to the leadership of MoH that can implement the strategy and action plan at centeral MOH and its sub offices across Libya.
Approval Process:
After incorporation of received feedback, the second draft of the policy, strategy and costed action plan will be shared with the Nursing and Midwifery steering committee for approval. After comments from this committee have been incorporated, the final draft policy, strategy and action plan will be presented by the MOH relevant senior officials to the office of H.E. The Minister of Health in Libya.
Consultant profile
· Sensitivity to cultural diversity, good analytical, negotiating, and communication and advocacy skills, report writing skills.
Management
Under the overall guidance of the UNFPA’s Representative in Libya and direct supervision of the Reproductive Health Specialist, the consultant will work in close collaboration with UNFPA Technical Specialist and the Head of the assigned Departments in MOH.
A working team identified by the MoH and UNFPA national programme staff will provide guidance to the consultant on a day to day basis. The government technical official (Head of HR Directorate) in MoH will chair and UNFPA will provide regular support to the team. The Chair is responsible for circulating all communication and clarifications made by the consultant to all members of the team. The final approval of the Policy, Strategy and Action plan lies with the Ministry of Health. The consultant will be required to work together with the working team in seeking any clarifications and technical advice.
UNFPA’s payroll management agency will provide the consultants with the following:
i. In-country guidance regarding transportation and help in facilitating the accommodation
ii. Relevant documentation and support meetings with partners when and where necessary
iii. Internet and working space during her working hours in UNFPA country office - Libya
Location and Timeframe
The consultant will be based in Ministry of Health, Tripoli – Libya. The consultancy is expected to begin in September 2020. The total duration of the assignment is not expected to exceed three months. The consultancy will follow the Libyan civil servant calendar which marks Friday and Saturday as the days off. A five days working week has been taken into account while calculating fees and per diems.

Travel costs
UNFPA Libya will pay:
ü A round trip economic air ticket between the originating city/duty station and Tripoli, Libya as well as visa fees
ü Daily Substance Allowances (DSA) will be paid to cover for local transportation, boarding and lodging in Tripoli and in major cities if required
Remuneration
UNFPA Libya will pay:
ü Consultancy fee commensurate with the assignment and level of experience of the consultant
ü Daily Subsistence Allowance (DSA) in line with UN standards rate for Tripoli - Libya
ü 30% of the payment will be made up on receipt of the inception report
ü 30% of the payment will be made up on receipt of Policy and Strategy document.
ü 30% of the payment will be paid up completion and approval of above documents and the costed action plan
ü 10% of the remaining amount will be paid at submission of final report and completion of the contract.
ü UNFPA reserves the right to withhold all or a portion of payment if performance is unsatisfactory, if work/outputs are incomplete, not delivered or for failure to meet deadlines.

The UNFPA’s contractor / payroll management agency (CTG) will facilitate the process for obtaining security clearance for the International Consultant prior to arriving in Libya.

The expert is responsible for his/her own working tools and space such as laptop, printing and internet connection. The expert must note that UNFPA cannot offer computer equipment for the purposes of this assignment.
Depending on UNSMIL SIOC and UNFPA approval the consultant might be required to work from UNFPA country office in Tripoli and will be required to attend to several meetings given that COVID19 situation allows.
The expert must take the necessary measures to ensure the visibility of UNFPA and EU as the donor for this project.
All reports records or materials acquired, compiled or prepared by the expert in the performance of the contract shall be the absolute property of UNFPA. The expert shall, upon completion of the contract, deliver all such documents and data to UNFPA. The expert may not retain copies of such documents and data and shall not use them for purposes unrelated to the contract without the prior written consent of UNFPA. The expert shall not publish articles relating to the services or refer to them when carrying out any services for others, or divulge information obtained from UNFPA, without the prior written consent of UNFPA. Any results or rights thereon, including copyright and other intellectual or industrial property rights, obtained in performance of the Contract, shall be the absolute property of UNFPA, which may use, publish, assign or transfer them as it sees fit, without geographical or other limitation, except where intellectual or industrial property rights already exist.
Experts will mainly follow the Libyan civil servant calendar which marks as week end the day of Friday and Saturday. In case a national holiday falls during the period the experts are in Libyan agreement needs to be asked for from UNFPA. A 5-day working week has been taken into account while calculating fees and perdiems.
