Background:

The OSCE Presence in Albania (hereinafter “The Presence”) work on environmental governance builds on a series past interventions that have laid the foundation of initial actions in the area of environmental enforcement by introducing a multi-agency approach working with environmental law authorities, police, prosecution, local government and NGOs and academia. Under the Extra Budgetary project “Enhancing environmental governance and security in Albania”, the Presence aims to enhance environmental governance and security in the country and to tackle environmental violations, by providing institutional and operational cooperation, delivering technical expertise and developing tools through on job learning.

In this context, the Presence will conduct an analytical assessment (baseline study) of the legal framework, institutional capacities and existing co-operation and gaps regarding environmental inspection, enforcement, prosecution, and judicial handling in Albania. The project will contract three experts to perform this assignment: one legal expert, one institutional expert, and one environmental expert.

In this context, the Presence seeks to contract one national senior environmental expert to conduct the legal framework analytical assessment as part of the baseline study.

Within this framework, the Presence seeks to contract one national environmental expert to conduct the drafting of the baseline study

Objective of Assignment:

The Governance in Economic and Environmental Issues Department seeks to engage the services of one national senior environmental expert to conduct the drafting of the baseline analytical assessment.

The national expert will work in parallel with two (2) more national experts for this task, one institutional and one senior legal expert, however with clear separated tasks. The coordination and tasks synergy will be led by the OSCE Project Manager

Duration of Assignment:

The expert shall be working for a period from 10 September to 30 December, not exceeding 30 working days

Tasks and Responsibilities:

Under the supervision of National Program Officer on Local Government and Environmental Governance, the consultant will perform the following tasks:

Task 1. Conduct desk research. Conducting desk research of the key environmental plans, policies and compliance procedures within Ministry of Tourism and Environment, Albanian State Police, General Prosecution Office (GPO) and five (5) national environmental agencies regarding environmental offenses, co-operation chain and information sharing protocols. This task will be finalised in two (2) weeks after contract signature.

Task 2. Conduct interviews. Based on the analyses under Task 1, the expert will prepare a semi-structured questionnaire for interviews with key stakeholders such as Ministry of Tourism and Environment, Ministry of Interior, Albanian State Police, General Prosecution Office, the Academy of Security, judges and other relevant non-state actors like NGOs and academia. The semi-structure questionnaire should address issues such as: environmental offenses data analyses practises, data availability, management and sharing among institutions, performance indicators. The semi-structured questionnaire and list of key stakeholders, as identified and prepared by the expert, should be cleared with the Project Manager before conducting the interviews. This task is supposed to take place during 1 – 15 October 2022.

Task 3. Drafting of baseline assessment. Prepare and deliver a first draft assessment report with findings from research, interviews, and the suggested recommendations. A preliminary structure and draft of the report should be cleared by Project Manager before the drafting phase. This task shall be finalised within 10 November 2022.

Task 4: Present the findings in consultation workshop. In coordination with the Project Manager, the expert is expected to attended consultation meetings with central institutions and present the findings from the baseline assessment. The consultation meetings will be facilitated by the Presence. Upon finalization of the meetings the expert is expected to deliver a consultation report with input from institution that will be included in the final draft of the assessment.

Task 5. Finalise the baseline study. The expert will prepare and finalize the environmental assessment, reflecting sector analysis, data analysis finding, recommendation and input collected from consultation meetings with central institutions and deliver to the Project Manager. The final draft shall be delivered within the first week of December 2022.

D1. Deliver an inception report which includes, outlining the methodology (key stakeholders, outline of the final report, areas to be addressed) for the environmental assessment, in Albanian language, Word format, in A4 pages. 30 September 2022
D2. Deliver the draft environmental assessment report section in Albanian language, in Word format. (Task #2&3) 10 November2022
D3. Attend and present a presentation for the consultation workshop and deliver the final draft of environmental assessment section. Word format (Times New Roman. (Task #4&5) 10 December 2022

Necessary Qualifications:

• Advanced degree in law or environmental planning disciplines; (Mandatory)
• A minimum of five years of work experience as environmental and/or researcher/consultant/expert in the field on environment issues;
• In-depth understanding of the country`s environmental framework; (Mandatory)
• Proven experience and knowledge of environmental protection/enforcement/environmental crime field;
• Proven experience in knowledge of the Donor’s Community work and engagement in area of environment protection/enforcement/crime would be considered an added value;
• Excellent communication, drafting and presentation skills in Albanian and in English

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
