Background

The OSCE Programme Office in Dushanbe (further - PoiD), within the framework of its Anti-Trafficking project, conducts a range of activities on combatting trafficking in persons in Tajikistan. Among these activities is provision of legal protection and representation to the most vulnerable TiP victims. This task will be conducted by the national expert with legal background and experience of participation in criminal proceedings on TiP-related cases and protection of the TiP victims' rights.

Brief description:

The national legal expert will be responsible for provision of legal representation and protection support (present and protect the rights and interests) to the victims of trafficking in persons (further - TiP) within the criminal proceedings of Tajikistan. This will include direct participation in all interrogations at the stage of preliminary investigation and court hearings of the specific TiP related cases, regardless the time and place of conduct. It is anticipated that the national legal expert will develop and submit reports on protection of the rights/interest of victims within each particular TiP case to the staff of the OSCE Anti-Trafficking Project.

Objective:

To provide legal protection and legal representation to TiP victims.

Tasks and Responsibilities

Under the supervision of the National Anti-Trafficking Officer the national legal expert will perform the following tasks:

  • Directly protect the rights and represent the interests of most vulnerable victims of TiP (depending on the procedural situation as injured party and witness) within the criminal proceedings (from the moment of initiation of TiP-related criminal case, at the stage of preliminary investigation and in court hearings) in the performance of procedural actions including:
  • To present evidence, fill motions and raise objections in best interest of victim;
  • To receive a copy of procedural documents, including the indictment and the verdict;
  • To get acquainted with the protocols of investigative actions carried out with his/her participation and submit comments on them;
  • To get acquainted with the protocol of the court session (other materials of the case) and submit comments on it;
  • To participate, with the permission of the investigator or the inquiry officer, in investigative actions carried out at his/her request or at the request of his/her legal representative or representative;
  • To get acquainted at the end of the investigation with all the materials of the case, to write out the necessary information from it, to participate in judicial discussions and debates in the court of first instance during the proceedings;
  • To fill a claim for compensation of harm caused by a crime;
  • To appeal against the actions or decisions of an inquiry officer, investigator, prosecutor, court, judge;
  • To appeal against a sentence or ruling or court order;
  • To be notified of the complaints and protests brought in the case and to file objections to them;
  • To realize other procedural rights and commit actions as prescribed by the Criminal Code and Criminal Procedural Code of Tajikistan;
  • Provide free legal aid to TiP victims in accordance with terms of concluded contract;
  • Provide the clients with advice, consultations, explanations and conclusions on legal issues related to the criminal cases, in which TiP victims participate as party of the process and facilitate the implementation of the rights by TiP victims;
  • Represent the rights and interests of the TiP victims before third parties, including state bodies, organizations and institutions, whose competence is to resolve issues related to the criminal cases, in which TiP victims are participate as party of the process;
  • Draw up documents (draft documents) of a legal nature related to the protection of the rights, freedoms, interests of the TiP victims and related to the criminal cases, in which TiP victims participate as party of the process;
  • Act in good faith while protecting the rights and observing the interests of the TiP victims;
  • Comply with the Code of Professional Ethics of Advocate while performing his/her responsibilities;
  • To maintain confidentiality of the TiP victims (that is, not to disclose information that became known to him/her in the course of work with TiP victims) and other advocate secrets in the manner prescribed by the legislation of Tajikistan and Code of Professional Ethics of Advocate;
  • Provide other legal assistance as needed to secure the effective protection of the rights and interests of the victims.

Expected Output/Deliverable:

  • The rights and interests of the TiP victims are presented and protected within the criminal proceedings;
  • The filled report submitted on the results of protection of the rights and representation of the interests of TiP victims at each stage of the criminal process: after the initiation of a criminal case, at the end of the preliminary investigation and trial, to track the deliverables of the services;
  • Final report submitted after completion of a criminal case/sentencing in a criminal case with summary of the results of services provided and rights of the TiP victims protected.

Necessary Qualifications

  • Higher legal education supplemented by specific studies in world of law;
  • Minimum 5 years of experience in advocatory activities in Tajikistan;
  • Experience in participation in criminal proceedings;
  • Experience in protection of the rights of TiP victims would be considered as advantage;
  • Good knowledge of criminal and administrative legislation of Tajikistan;
  • Good reporting skills;
  • Knowledge of Russian and Tajik languages.

Remuneration Package

The consultant will be remunerated commensurate with consultant's experience and qualifications in accordance with OSCE established rates. Applicants should indicate whether they wish to be included in the OSCE Roster of Consultants for similar assignments.
