Background:

The OSCE Presence in Albania (hereinafter “The Presence”) work on environmental governance builds on a series past interventions that have laid the foundation of initial actions in the area of environmental enforcement by introducing a multi-agency approach working with environmental law authorities, police, prosecution, local government and NGOs and academia. Under the Extra Budgetary project “Enhancing environmental governance and security in Albania”, the Presence aims to enhance environmental governance and security in the country and to tackle environmental violations, by providing institutional and operational cooperation, delivering technical expertise and developing tools through on job learning.

In this context, the Presence will conduct an analytical assessment (baseline study) of the legal framework, institutional capacities and existing co-operation and gaps regarding environmental inspection, enforcement, prosecution, and judicial handling in Albania. The project will contract three experts to perform this assignment: one legal expert, one institutional expert, and one environmental expert.

In this context, the Presence seeks to contract one national institutional expert to conduct the assessment of the central environmental inspection institutions, enforcement agencies (Police, Prosecution) capacities as part of the baseline study.

The national expert will work in parallel with two (2) more national experts for this task, one senior legal and one environmental expert, however with clear separated tasks. The coordination and tasks synergy will be led by the OSCE Project Manager

Objective of Assignment:

The Governance in Economic and Environmental Issues Department seeks to engage the services of one national institutional expert to support the support the assessment of the central environmental institutions, and enforcement agencies’ capacities, co-operation arrangements and data sharing protocols.

Duration of Assignment:

The expert shall be working for a period from 10 September to 30 December, not exceeding 25 working days

Tasks and Responsibilities:

Under the supervision of National Program Officer on Local Government and Environmental Governance, the consultant will perform the following tasks:

Task 1. Conducting desk research. The expert will analyse key central environmental institutions and enforcement (Police and Prosecution) agencies relations in regard to environmental offences case management, competences and shared function (overlapping).

Task 2. Conduct interviews. Base on the analyses under Task 1, the expert will prepare a semi-structured questionnaire for interviews with key stakeholders as identified under Task 1. The semi-structure questionnaire should envisage i) to understand the knowledge of employee’s role and institution competences ii) human and technological capacities, and iii) their Standard Operating Procedures. The semi-structured questionnaire and list of key institutions, should be cleared with the Project Manager conduction the interviews. This task is supposed to take place during 1 – 15 October 2022.

Task 3: Draft the baseline assessment component on institutional capacities. The expert shall prepare and deliver a first draft assessment report with findings from research and interviews, and the suggested recommendations. A preliminary structure and draft findings of the report should be cleared by Project Manager before the drafting phase. This task shall be finalised within 10 November 2022.

Task 4. Present the finding in consultation workshops. In coordination with the Project Manager, the expert is expected to attended consultation meetings with interviewed institutions and agencies, and present the findings from the assessment. The consultation meetings will be facilitated by the Presence. Upon finalization of the meetings, the expert is expected to deliver a consultation report with input from institution that will be included in the final draft of the assessment. Consultation meetings to take place during the period 10 -20 November 2022.

Task 5: Finalize the institutional component of the Baseline Study. The expert will prepare and finalize the institutional assessment, reflecting finding, recommendation and input collected from consultation meetings with central institutions and deliver to the Project Manager. The final draft shall be delivered within the first week of December 2022.

D1. Deliver an inception report which includes, outlining the methodology for the institutional assessment in Albanian language, WORD format (Times New Roman), not longer than 15 A 4 pages. 30 September 2022
D2. Deliver the draft institutional assessment report in Albanian language, in Word format. (Task 2 and 3) 10 November 2022
D3. Attend and present a presentation for the consultation workshop and deliver the final draft of legal assessment. Word format (Times New Roman. (Task 4 and 5) 10 December 2022

Necessary Qualifications:

• Advanced degree in law, security and social science disciplines; (Mandatory)
• A minimum of five years of work experience as conducting researcher/consultant/assessment on government institutions and its central agencies in the field on environment;
• In-depth understanding of the country`s legal framework on environment, institutional environmental competence and the inter-institutional cooperation at central and local level;
• Proven experience and knowledge of environmental protection/enforcement/crime assessment field;
• Excellent communication, drafting and presentation skills in Albanian and in English;
• Knowledge of the OSCE local governance commitments will be an added advantage.
• Computer literate.

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
