The OSCE Mission to Bosnia and Herzegovina continues to play a vital role in strengthening the country's ability to foster a sustainable and stable security environment, to strengthen Bosnia and Herzegovina's governance, and to encourage its consolidation as a democratic society. The Mission supports political and education reform and works to promote and protect human rights of all citizens of BiH. The Mission is co-implementing the Extra Budgetary project "Supporting a More Effective Judicial Response to Corruption and Organized Crime in the Western Balkans", which will focus on supporting a more effective administration of justice with regards to serious corruption and organized crime cases in BiH, through trial monitoring. Objective Should you be selected for the position, you will provide advice, expertise on legal/substantial aspects of the project throughout its duration. You will also participate in several key activities and deliver specific tasks. Deliverables and performance indicators:

  • Inception Report foreseen in the 1st year of the Project;
  • 1st Trial Monitoring Report in the second year of the project;
  • 2nd Trial Monitoring Report in the third year of the project.

Tasks and Responsibilities

Should you be selected for the position, you will perform the following duties: Implementation of the Inception phase and Inception Report (1st year of the project)

1. Gathering appropriate baseline data, such as on the volume of cases and statistical trends in judicial response to OCC in BiH;

2. Drafting a desk review of the institutional, normative, and legal background related to judicial response to OCC in BiH;

3. Addressing any comment on the draft raised in the course of the clearance and finalization process;

4. Proposing contingency planning for flexibility arrangements in BiH following the Inception Phase in case of disruption due to COVID-19;

5. Assisting the Team Leader in the implementation of the project methodology in BiH, particularly by ensuring that the methodology is consistently applied in the different legal and judicial systems of BiH.

Drafting of the 1st Trial Monitoring Report (2nd year of the project)

1. Assessing and elaborating on the trial monitoring analysis and findings prepared by the Project Staff based on the initial twelve months of trial monitoring;

2. Assessing and organizing the inputs gathered in the course of consultations and discussion forums with domestic counterparts;

3. Ensuring that the overall assessment for BiH takes into due consideration the variety of judicial systems existing in BiH as well as the different judicial practices in the Country;

4. Taking the lead in the actual drafting of the analytical section of the report for BIH, including an assessment of the effectiveness of judicial response to OCC based on the trial monitoring findings in the cases monitored in BiH;

5. Taking the lead in the actual drafting of the sections of the BiH report dedicated to the production of tailor-made recommendations for a more effective response to OCC;

6. Addressing any comment on the draft raised in the course of the clearance and finalization process.

Drafting of the 2nd Trial Monitoring Report (3rd year of the project)

Support of analysis of monitored OCC cases (Throughout the duration of the project)

1. Reviewing and providing feedback on the internal reports drafted by the Project Staff with regard to the monitoring of individual cases;

2. Ensuring that the analysis complies with the different aspects of the project methodology;

3. Suggesting ways to improve the quality of internal reports on the monitoring of cases.

Necessary Qualifications

  • Advanced University degree in law;
  • Minimum 8 years of progressively responsible and relevant professional experience in the field of criminal justice, either as an expert in projects aimed at assessing the needs of the judiciary in the processing of complex criminal cases or as a practitioner working in national or international criminal courts;
  • Prior experience with trial monitoring of corruption or organized crime cases;
  • Prior experience in drafting analytical reports on the processing of complex criminal cases;
  • Excellent knowledge of international standards and OSCE commitments in the field of rule of law reform processes;
  • Knowledge of the BiH political situation and judicial structure, including the framework pertaining to the processing of organized crime and corruption;
  • Project implementation experience in BiH is desirable;
  • Computer literate with practical experience with Microsoft applications;
  • Excellent written and oral communication skills in English.

Remuneration Package

Remuneration will depend on the selected consultant's qualifications and experience and be in accordance with OSCE established rates.
