Result of Service

Working closely with the GPTOC advisor and in coordination with other LEAP partners and the UNODC Indonesia national forestry programme staff, the consultant will: i) Prepare assessment reports for Indonesia, Papua New Guinea and Solomon Island on the main gaps and challenges in the policies, legal frameworks, institutional arrangements and national coordination and practices in the detection, investigation and prosecution of forestry related crimes as transnational organized crime and make recommendations for improving the effectiveness to address forestry crime as transnational organized crime. The assessment reports will require review of laws, regulations and reports of UNODC, other organization and civil society including information on types and number of offenses investigated and prosecuted and valuation of the products, if possible, to illustrate or to provide evidence on how the legal framework is used to address forestry crime as organized crime. The assessment will also require coordination with the LEAP team to prepare a list of persons to be interviewed.

ii) Engage in any required discussion on the reports with the UNODC LEAP team or external experts and other stakeholders.

iii) Prepare and present a 20-30minute presentation of the report at meetings for key stakeholders (LEAP team members, the donor, civil society, and the Indonesian government).

iv) Participate in a minimum of 2 meetings of all LEAP partners (UNODC, Interpol and Rhipto) and provide legal advice on forestry matters to LEAP Team members, as required.

v) Develop 2 short guides (max 10-15 pages) on issues that come out of the assessments or other work done by LEAP partners.

vi) Collect good practices and case examples that can be shared with stakeholders, used in training activities or for legislative assistance, and provided to the UNODC SHERLOC database.

Background of the assignment: In 2018, UNODC initiated the Law Enforcement Assistance Programme to Reduce Tropical Deforestation (LEAP) in partnership with INTERPOL and the non-governmental organization, Norwegian Centre for Global Analysis (RHIPTO). LEAP supports countries in Latin America and Southeast Asia to strengthen the capacities of officers responsible for frontline enforcement, investigation, prosecution and customs efforts to prevent illegal deforestation, track illicit shipments, and seize assets. The focus is on operational support to address the illicit trafficking in timber as transnational organized crime. Within UNODC the LEAP project is implemented by the Container Control Programme (CCP), the Global Programme against Money Laundering and Terrorist Financing (GPML) and the Global Programme to Support the Capacity of States to Prevent and Combat (transnational) Organized and Serious Crime (GP-TOC), which focuses on support to prosecutors, civil society and legal issues. Other LEAP programmes/partners provide research analysis, support to law enforcement and customs authorities, to financial intelligence and anti-money laundering units and they coordinate regional and global operations. The target countries of the LEAP programme in South East Asia are Indonesia, Papua New Guinea (PNG) and the Solomon Islands and in Latin America are Colombia, Ecuador and Peru with Brazil being an associated country.

Purpose of the assignment: Working closely with the GPTOC advisor and in coordination with other LEAP partners and the UNODC country and national offices of LEAP target countries, the purpose of the assignment is to provide advice and expertise to the LEAP programme and particularly to the GPTOC component including by undertaking assessments of policies, legislation, of institutional arrangements, national practices and inter-agency coordination in the detection, investigation and prosecution of forestry related crime and to collect good practices and develop practical guides for practitioners.

Qualifications/special skills

Skills: Excellent report drafting skills is desirable.

Good interpersonal and communication skills is desirable.

Academic Qualifications: An advanced university degree (Master's degree or equivalent) in law is required.

A first level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree.

Experience: At least ten (10) years of experience in the area of environmental/forestry/wildlife related crime (including assessing legislation) is required;

At least three (3) years of criminal justice experience, preferably as a prosecutor or in law enforcement is required;

Experience in environmental or forestry related governance is desirable;

Knowledge about regulatory and justice sector institutions and their roles in preventing and combating illicit trafficking in timber and related offenses is desirable.

Language: English and French are the working languages of the UN Secretariat. For this position, fluency in English (oral and written) is required. Knowledge of Bahasa, Indonesian and of Spanish is desirable. Knowledge of another official United Nations language is an advantage.
