Purpose of the assignment

To support the Ministry of Justice (Adalat) and involved Government institutions to a comparative analysis of the legislation of Turkmenistan and its compliance with the 1989 Convention on the Rights of the Child, the International Covenant on Civil and Political Rights of 1966, the 1961 Convention on the Reduction of Statelessness and the United Nations Guidelines for Legislative Framework for Civil Registration, Vital Statistics and Identity Management and UN Legal Identity Agenda.

Specific Tasks

  • Conduct a comparative review of the legislation of Turkmenistan and its and its compliance with the 1989 Convention on the Rights of the Child, the International Covenant on Civil and Political Rights of 1966, the 1961 Convention on the Reduction of Statelessness and the United Nations Guidelines for Legislative Framework for Civil Registration, Vital Statistics and Identity Management and UN Legal Identity Agenda.
  • Support the Ministry of Adalat to update the regulations in:

а) Monthly provision of information to the Registry Offices on births from the Health institutions

b) provision of the information on CRVS to the State Statistics Committee from Registry Officer

c) develop regulations on data provision among above mentioned entities.

Workplan and deliverables

The consultancy will cover the period of 15 April 2021 - 15 June 2021 (10 working days) and will be deliverable based. The consultant is expected to work from home. Specific tasks may be adjusted based on current events and corporate priorities.

Reporting requirements

International Consultant will provide reports upon completion of the deliverable at the end of the assignment.

Payment schedule

The payment in US dollars will be made on a one-time basis upon satisfactory and timely submission of the Final Report.

Work arrangements

Day to day supervision and guidance will be provided by UNICEF Turkmenistan Child Rights Monitoring Specialist with consultations from Deputy Representative and Programme colleagues. UNICEF will regularly communicate with the International Consultant and provide UNICEF and UN requirements, guidance on specific questions, feedback on performance, and all other necessary support to achieve the objectives of the consultancy.

General Terms and Conditions

UNICEF's general terms and conditions will apply to the contract awarded to the vendor. Please note that, in the evaluation of the technical merits of each proposal, UNICEF will take into consideration any proposed amendments to the UNICEF General Terms and Conditions. Proposed amendments to the UNICEF general terms and conditions may negatively affect the evaluation of the technical merits of the proposal.

UNICEF retains the right to patent and intellectual rights, as well as copyright and other similar intellectual property rights for any discoveries, inventions, products, or works arising specifically from the implementation of the project in cooperation with UNICEF. The right to reproduce or use materials shall be transferred with written approval of UNICEF based on the consideration of each separate case. The consultant should always refer to UNICEF Turkmenistan's support in developing the materials when publishing the results of the research conducted while in Turkmenistan in academic journals, books, and websites.

In the event of unsatisfactory performance, UNICEF reserves the right to terminate the Agreement. In case of partially satisfactory performance, such as serious delays causing the negative impact on meeting the programme objectives, low quality or insufficient depth and/or scope of the assignment completion, UNICEF is entitled to decrease the payment by the range from 30% to 50% of the contract value as decided jointly by the Contract Supervisor and Operations Manager.

Qualifications and Skills Required

  • Proven expertise in Civil Registration Unified Systems development and consultancy;
  • Extensive experience in having undertaken similar assignments;
  • Advanced degree in IT, statistics, social sciences, or a closely related field;
  • Expertise in Central Asian countries is an advantage;
  • Strong analytical skills, including experience in preparation of reports;
  • Excellent communication and presentation skills;
  • Excellent working with people and organizing teamwork skills;
  • Fluency in English is required; Knowledge of Russian is a significant advantage.

The technical proposal should include

    • Assessment of suitability vis-à-vis the requirements of this ToR;

Financial Proposal

Candidates are expected to submit a lump sum financial proposal to complete the entire assignment based on the terms of reference. The lump-sum should cover the deliverables indicated above for the period of 15 April 2021 - 15 June 2021 (10 working days) (10 working days). Financial proposals should be submitted in USD.

Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.
