Background

The Sawasya II programme: Promoting the Rule of Law in Palestine represents the primary programmatic vehicle of the United Nations for advancing the rule of law, integrity, gender justice and human rights in Palestine for the period 2018-2022. Bringing together the main UN entities mandated and invested in these areas in an integrated programme framework (three years, with provision for a further two optional years), Sawasya II seeks to elevate the state building enterprise for a progressively functioning and increasingly inclusive State of Palestine that respects, protects and fulfils human rights and gender equality, and promotes development, peace and security. The programme has a dedicated output (2.1.) which aims at improving the quality and efficiency of security and justice services. Under this output, the Programme provides support to the public prosecution, through its human rights unit, in monitoring places of detention.

The public prosecution plays an important role in implementing the human rights obligations of the State of Palestine as per the human right treaties it has acceded to. The Human Rights Unit (HRU) at the Attorney General's Office (AGO) was activated in January 2017, with the overall mandate to mainstream human rights principles into the work of the Public Prosecution. One of its main functions is receiving and resolving public grievances and accepts, all complaints on human rights violations by the judiciary police, security forces and members of the Public Prosecution, initiates investigations into those violations, and tracks them within a certain timeframe, as well as follows up on the complaints submitted by detainees. HRU team is receiving annually complaints against Palestinian security forces for committing ill-treatment and torture actions toward citizens, and accused persons during pre-detention stage of investigations.

To that end, Sawasya II is seeking a national/ international consultant specialised on investigation and documentation of torture and other cruel, Inhuman, or degrading treatment of punishment complaints as per Istanbul protocol. The overall objective of this assignment is to to build the capacity of members of the human right unit in AGO in evidence-based investigation, documentation and reporting on the ill-treatment and torture complaints based on Istanbul Protocol.

The expert will perform his/her tasks under the supervision of the Sawasya II Human Rights Coordinator and Program Specialist on Access to Justice and in close collaboration with human right unit team in public prosecution.

Duties and Responsibilities

The Consultant's main tasks will be the following:

• Review relevant laws, instruments, documentation, and reports on on public prosecution in general and on Human Right Unit (HRU) focussing on complaints documentation, investigation and processing including the detainee's complaints. As well conduct interviews with the head of human right unit, and other related units, departments in AGO.
• Design the training agenda on ill -treatment and torture complaints investigation, documentation, and processing.
• Develop the training materials for the participants, taking in consideration Istanbul Protocol and best practice model.
• Conduct 4 training days divided in two workshops for prosecutors with clear guidance of implementing Istanbul protocol.
• Final report on the training workshops recommendations and enhancement of an effective ill-treatment and torture complaints investigation and documentation mechanism in HRU-AGO based on Istanbul Protocol.

• Final report and recommendations of the workshop as well recommendations on enhancement of an effective investigation torture complaints mechanism

• At least 5 years of experience working in CSOs in handling ill -treatment and torture complaints.
• At least two-year experience of training in the field of complaints investigation, documentation and processing based on best practice models and Istanbul Protocol.
• At least two-years' experience.
• At least two-year experience participating in torture complaints investigation missions.
• Experience working with large UN rule of law programmes is an asset.

INSTRUCTIONS TO APPLICANTS

1. Introduction

UNDP/PAPP seeks technical proposals from qualified individual consultants to build the capacity of public prosecution - human right unit in effective investigation and documentation of torture and other cruel, Inhuman complaints.

2. Documents comprising the Technical and Financial Proposals

Interested individual consultant must submit the following documents/information, which comprises the Technical& Financial Proposals:

• Provide Curriculum vitae form including past experience in the field of rule of law, human rights and reforming justice sector institutions.
• Proposed methodology to achieve the tasks included in the ToR (not more than 5 pages)
• Sample of training reports in the same field.
• Completed financial proposal form, found under Annex III: the financial proposal is all-inclusive and shall take into account various expenses incurred by the consultant while fulfilling its mission (e.g. transportation cost...).

3. Evaluation

Preliminary examination

UNDP/PAPP will examine the Proposals to determine whether they are complete, and whether they are substantially responsive to the qualification and experience minimum requirements. A Proposal determined as not substantially responsive will be rejected by UNDP/PAPP and may not subsequently be made responsive by the Applicant by correction of the non-conformity.

Detailed examination

Individual consultants will be evaluated based on a cumulative analysis taking into consideration the combination of the applicants' qualifications and financial proposal.

Only those candidates who will obtain min. 70 points for the technical evaluation will be assessed for the financial proposal evaluation.

4. Award of Individual Contract

The procuring UNDP entity reserves the right to accept or reject any Proposal, and to annul the solicitation process and reject all Proposals at any time prior to award of contract, without incurring any liability to the affected applicant or any obligation to inform the affected applicant or applicants of the ground for the UNDP's action.

The award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the

highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Highest score / combined score calculation methodology: 100 points shall be allocated to the lowest total fees proposed among those invited candidates which were successful in the evaluation of the technical proposal (i.e. obtained a technical score of 70 or more). All other fees proposals shall receive points in inverse proportion to the lowest total fees; e.g. [100 Points] x [US$ lowest total fees] / [US$ other] = points for other proposer's fees.

FINANCIAL PROPOSAL FORM

Your financial offer in USD shall specify

a lump sum figure all-inclusive and shall take into account various expenses incurred during the contract period and shall form the amount of the resulted contract between the winning Consultant/Contractor and UNDP. No other entitlements will be considered after submission of financial proposals.

The financial proposal shall include a breakdown of this lump sum amount (number of anticipated working days, all envisaged travel (such as but not limited to all travel to join duty station/repatriation travel), per diems/daily allowances). Fee Breakdown should be attached under a separate sheet.
