The ILO is issuing a call for expressions of interest for experts in Development of Labour Legislation and Support Effective Enforcement of Labour Rights who wish to be included in a consultancy database currently being compiled by the ILO Decent Work Technical Support Team and Country Office for Eastern Europe and Central Asia .

Interested consultants are invited to submit their application on-line in order to establish their profile in the database from which they may be considered for consultancy opportunities that may arise. Inclusion in the database does not guarantee a contract with the ILO. You will be contacted directly by the concerned departments/office if preselected.

Background

In November 2017 the International Labour Organization and the Government of Denmark signed four-year agreement for the implementation of the project “Inclusive Labour Market for Job Creation in Georgia”. The project aims at improving labour market institutions that encapsulate and/or have the capacity to develop legislative and policy frameworks, as well as deliver services, which will lead to a well-functioning labour market that generates decent work opportunities.

In line with its international commitments, Georgia has made a significant progress in adopting legislative changes and implementing policy reforms to promote safety at work and establish an effective enforcement mechanism. On September 29, 2020 the Parliament of Georgia voted for amendments to the Organic Law of Georgia “Georgian Labour Code” and adoption of the new Law of Georgia on “Labour Inspection”. Amendments to the Labour Code outstandingly strengthen the legal framework for the protection of the labour rights of Georgian workers by meeting the requirements of GSP (generalized system of preferences), EU-Georgia Association Agreement and International Labour Organization.

Georgian Labour Code defines that state supervision over labour legislation of Georgia is ensured by the LEPL Labour Inspection functions, authority and power of which is guaranteed by the newly adopted Law of Georgia on Labour Inspection. Law of Georgia on “Labour Inspection” establishes an independent enforcement body, LEPL Labour Inspection Service and defines basic principles, authority and power of inspection, rights and obligations, and ensure effective implementation of labour norms.

In order to give effect to the above-mentioned laws a number of steps are to be taken by the Government of Georgia.

Objectives

The objective of the assignment is to elaborate bylaws that are determined by the transitional provisions in the recently amended Organic Law of Georgia “Georgian Labour Code”, in particular: 1. The Government of Georgia shall approve the List of fields of Specific Working Regimes;

2. The Ministry of Internally Displaced Persons from the Occupied Territories, Labour, Health, and Social Affairs of Georgia shall: a) ensure the approval of the rules for the regulation of working hours in the mining sector;

b) ensure approval of the proportional rate of night work within the annual working hours;

c) ensure the scope and intervals for health assessment for night-time employees;

d) ensure the approval of the list of vital jobs and the limits of a minimum service.

Expected Outputs

The National Consultant is expected to complete the following outputs:

  • Develop/elaborate relevant legislative acts envisaged in the labour legislation through consultations with the Ministry and social partners;

Required qualifications

Education

University Degree or equivalent in law, public administration or related fields; advanced degree is an asset.

Experience

Experience in the labour inspection and public administration system;

Experience working on similar assignments for international organisations or the public sector; previous work experience for the ILO or UN agencies is an advantage.

Languages

Strong speaking and writing skills in English.

Competencies

In addition to the ILO core competencies, this position requires: Technical

Demonstrated knowledge of labour law and relevant International Labour Standards is an advantage.
